Instructing solicitors shall treat all information supplied by Mr Bennett as confidential and shall not disclose indirectly or directly or otherwise use this information except for the purpose of the specified litigation without the prior consent of Mr Bennett.
Mr Bennett’s charges for preparing a report will be based on the complexity and length of the report. The standard fee is £400.00 payable within 30 days of receipt of the report.
An hourly rate of £200.00 will apply to all work subsequent upon the report.
If required to attend a Conference in Chambers, Mr Bennett’s charge will be £500.00 per half day.
If required to appear in Court, Mr Bennett’s charge will be £1,000.00 per day.
Mr Bennett shall be fully reimbursed for all travelling time at £50.00 per hour, first class train travel, car mileage at £0.80 per mile together with overnight stay and subsistence if required.
Instructing solicitors shall :-
- Ensure that Mr Bennett’s charges are no higher than reasonably necessary for the purpose of litigation, bearing in mind his professional expertise; and
- Where necessary, obtain prior approval from the Legal Aid Board of Mr Bennett’s charges
Instructing solicitors shall pay all sums due within 4 week of the date of invoice. Late payment will be subject to interest of 7% per annum. In the event of late payment, further reports and co-operation will be withheld until payment is received.
Dr Bennett reserves the right to require advance payment for work undertaken prior to supplying that work to instructing solicitors.
In the event of cancellation of a court appearance or settlement within 48 hours of the case, then the full fee will be charged, more than 48 hours but less than 2 week’s notice then 50% of the fee will be charged.
Instructing Solicitors shall be responsible for giving adequate instructions and shall check that all matters are covered in the reports. Instructing solicitors shall be responsible for any claim made against Mr Bennett resulting from their failure to do so.
The liability of Mr Bennett to instructing solicitors and/or their clients for negligence howsoever arising in respect of any loss or damage caused by an act or default of Mr Bennett shall be limited to the amount received by Mr Bennett for his services.
Due to his clinical work, at least 6 weeks notice should be given for Court appearance.
Solicitors to provide copies of GP, hospital records and x-rays. If these have to be obtained by Mr Bennett, any account due from the GP surgery/Hospital will be sent direct to the Solicitor and a £100.00 administration fee will be charged by Mr Bennett.
